Please see attached. This is the letter from the lawyer of the owner of 2230 Foster Dr. Yes, the tree is on HOA property. Yes, it is causing damage to their French drain.
The Cricket is their estimate and Lumberjacks is the estimate I got for them.
So, on the point of being responsible for this issue, we are not.
I have talked to Jeremy Anderson and went over the law on trees. He told me that they have every right to take out the roots that is causing the damage. And if we give them permission, they can remove the trees at their expense. There is noting wrong with the trees except the roots are growing. Please let me know as soon as you can what you think on this issue so that I can respond to the attorney letter.

I’ve asked kirby about their claim that the property owner has reached out to the board previously, I see no emails from them about this issue.
Eric (with Kirby) says that this was a discussion they had in person at the Kirby Management offices.
Decision made by the board to respond to the request with telling them that they have permission to remove the trees, but the board will not be paying towards their removal or repair of their property.
